Terms of Use

1. These terms

These Terms of Use are an agreement between you and TourStruct, which owns and operates the OffYaGo app. By downloading, opening or using OffYaGo, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the app.

2. What OffYaGo does

OffYaGo helps you plan trips. It suggests places, puts them in an order, estimates travel times and costs, and offers ideas for where to eat and stay. It is free to use and has no ads. We may add, change or remove features, and a test (TestFlight) version may be incomplete or change without notice.

3. Who can use it

You must be at least 16 to create an account. By creating one, you confirm that you are.

4. Your account

You sign in with Apple. Keep your Apple account secure, because anyone who can use it can use your OffYaGo account. Tell us straight away if you think someone else has used your account.

5. Planning information is a guide, not a guarantee

The places, descriptions, maps, travel times, cost estimates, weather and AI suggestions in OffYaGo are general information to help you plan. They come from sources such as Wikipedia, OpenStreetMap, Apple Maps, Open-Meteo and AI services, and any of them can be incomplete, out of date or wrong. They are not professional, legal, medical, safety or financial advice.

Check anything that matters to you, such as opening hours, prices, timetables, bookings, and entry, visa or health requirements, with the venue, operator or official source before you rely on it, book or travel. You are responsible for your own travel decisions. See where our information comes from.

6. Using the app fairly

Please don't:

• use OffYaGo for anything unlawful, or to harass or harm anyone;
• post content that is defamatory, obscene or infringes someone else's rights;
• interfere with, overload, reverse-engineer or try to break into the app or its servers;
• scrape or copy the app's content in bulk, or use automated tools to access it;
• pretend to be someone else.

7. Your content and your feedback

You own what you create in OffYaGo, such as your trips and anything you write. You let us store, process and display it so the app can work for you, and so it can be shown to people you choose to share it with.

If you send us feedback, corrections or suggestions, you agree that we may use them to improve OffYaGo, with no payment or obligation either way. We only publish a photograph you send us under a separate written agreement with you.

8. Our content

OffYaGo's design, software, our own descriptions and the OffYaGo name and logo belong to TourStruct or the people who license them to us. Some content belongs to others and is credited in the app and on our information sources page. You may use the app for your own personal trip planning, but not copy, sell or redistribute its content.

9. Other services

OffYaGo relies on services run by others, including Apple (Sign in with Apple, Apple Maps, Apple Intelligence), Amazon Web Services, Google (Firebase and Gemini), Perplexity, OpenStreetMap, Open-Meteo, the Wikimedia projects and Shutterstock. Their own terms apply to them, and we're not responsible for their content or their availability. Links to other websites, such as a venue's or an operator's, are for convenience, and we don't control those sites.

10. Disclaimer

To the extent the law allows, OffYaGo and its content are provided "as is" and "as available". We don't promise that the app will always be available, error-free or secure, or that its information is complete, accurate or current.

11. Limits on our liability

To the extent the law allows, TourStruct isn't liable for indirect or consequential loss, or for loss caused by relying on information in the app without checking it, such as a missed connection, a closed venue or a changed price. Because the app is free, where our liability can be limited, it is limited to resupplying the service.

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that can't lawfully be excluded.

12. Ending

You can stop using OffYaGo at any time, and ask us to delete your account. We may suspend or close an account that breaks these terms, or stop offering the app, and where we reasonably can, we'll tell you first.

13. Changes to these terms

We may update these terms. If a change matters, we'll tell you in the app before it takes effect. If you keep using OffYaGo after that, the new terms apply.

14. Law

These terms are governed by the laws of Australia. If any part of them can't be enforced, the rest still applies.
